Terms of Use

These terms are an agreement between you and CADMD SOFTWARE LLC, a Florida limited liability company (“we”, “us”), for the use of MillPath at millpath.app and its installed app (“MillPath”). By using MillPath you accept them. If you use MillPath for a company, you accept them for that company.

1. The service

MillPath is browser software that creates toolpaths and G-code for CNC machines. It is offered as a free plan and paid plans (Hobby, Pro) described on the pricing page. MillPath is in beta: features, limits and the posts for each controller may change. You must be at least 18 years old, or use MillPath with the consent of a parent or guardian.

2. Safety and assumption of risk

CNC machines can cause serious injury and damage. G-code made with MillPath moves real machines. MillPath checks its own output, but it cannot know your machine, its controller settings, its setup, your tools, your material, your work holding or your surroundings.

  • You must check every program before you run it, and run new files, posts, tools and machines in the air first, with the machine’s emergency stop within reach.
  • You alone are responsible for setting up and operating your machine safely and according to its maker’s instructions, for the protective equipment you use, and for everything a program does on your machine.
  • Feeds, speeds, depths and other values in MillPath — including built-in tools, posts and suggestions — are starting points, not recommendations for your material, tools or machine. MillPath is not professional engineering or machining advice.
  • The posts for each controller follow the controller makers’ documentation and are marked when they have not been confirmed on a machine.

YOU USE MILLPATH AND RUN THE PROGRAMS IT MAKES AT YOUR OWN RISK. Before the first G-code leaves MillPath you confirm this in the app.

3. Your files

Drawings, projects and G-code are processed in your browser and stay on your device. You keep all rights to your designs and to the G-code you make. You are responsible for having the right to use the designs, fonts and files you open in MillPath, and for keeping your own copies.

4. Licence

We grant you a personal, non-exclusive, non-transferable licence to use MillPath under your plan. The Hobby plan is for personal, non-commercial use; making things for sale or using MillPath for a business needs the Pro plan. MillPath, its software and its content belong to us and our licensors; these terms do not give you any other rights to them.

5. Paid plans, renewal and cancellation

  • Paid plans are billed yearly in advance and renew automatically each year at the price then shown, until you cancel. We will remind you by e-mail before a renewal.
  • You can cancel at any time in your account or by e-mailing us; you keep your plan until the end of the paid year and are not charged again.
  • Prices are in US dollars. Sales tax, VAT or similar taxes are added at checkout where they apply. Payments are processed by Stripe.

6. Acceptable use

Do not attempt to circumvent plan limits, break or overload MillPath, resell it, or use it to infringe anyone’s rights or break the law.

7. Beta software

MillPath is in beta. It may contain errors, and features, posts and limits may change or stop without notice.

8. No warranty

MILLPATH, ITS POSTS, ITS SUGGESTIONS AND THE G-CODE IT MAKES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS. WE DO NOT WARRANT THAT MILLPATH OR ANY PROGRAM IT MAKES IS FREE OF ERRORS, SAFE TO RUN, OR SUITABLE FOR YOUR MACHINE, TOOLS OR MATERIAL.

9. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, CADMD SOFTWARE LLC AND ITS MEMBERS, EMPLOYEES AND SUPPLIERS ARE NOT LIABLE FOR ANY DAMAGE TO MACHINES, TOOLS, MATERIALS, WORKPIECES OR OTHER PROPERTY, PERSONAL INJURY, LOST PROFITS, LOST PRODUCTION OR LOST DATA, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING FROM THE USE OF MILLPATH OR OF ANY PROGRAM MADE WITH IT, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID US FOR MILLPATH IN THE 12 MONTHS BEFORE THE CLAIM (OR US$50 IF YOU PAID NOTHING). Nothing in these terms limits liability that cannot be limited by law, such as for fraud or, where the law requires, for gross negligence or personal injury.

10. Indemnification

You agree to defend and indemnify CADMD SOFTWARE LLC against claims by third parties arising from your use of MillPath, the programs you run, or the things you make with it, including claims arising from your breach of these terms, except to the extent caused by our own wrongful act.

11. Ending use

You can stop using MillPath at any time. We may suspend or end access for a serious breach of these terms; if we end a paid plan for a reason other than your breach, we refund the unused part.

12. Changes

We may update these terms; the date above shows the current version. For a material change to paid plans we will tell you in advance by e-mail, and the change applies from your next renewal.

13. Law and disputes

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes are decided by the state or federal courts in Hillsborough County, Florida. If you are a consumer in the EU, the UK or another country whose law gives you rights that cannot be waived, or the right to bring proceedings where you live, those rights are not affected.

14. General

If a part of these terms is found unenforceable, the rest stays in force. These terms, the privacy policy and the refund policy are the whole agreement about MillPath.
